District, 879 P .2d 267 (Utah App. 1994) School districts may if they choose, recognize an exclusive bargaining representative and enter into an enforceable collective bargaining agreement with the representative provided that non of the school board's legislative authority is impermissibly delegated to an arbitrator under the agreement. Utah Op. Att'y Gen. No. 53-6-20 (1979) Collective bargaining agreement between education association and district was enforceable and did not constitute an impermissible delegation of the school districts legislative authority.
